Compensation
of Occupational Diseases
Most of the
occupational diseases are compensable. However, very few cases
are being compensated because of lack of awareness amongst the
workers and diagnostic errors. The NIOH took lead in helping
workers to get compensation for various occupational diseases.
The scientists personally appeared as expert witness in
various Courts. The compensation cases brought awareness
amongst the workers and forced the management to take
appropriate measures. Following are few examples:
Hon’ble
Supreme Court in its judgement of January, 1995 has identified
NIOH as the final authority for diagnosis of asbestosis for
compensation purpose. Large number of asbestos cement
workers have been compensated due to efforts of NIOH
scientists.
Cases
of silicosis diagnosed during the surveys in quartz grinding
industry, glass industry, agate industry, pottery industry,
sand grinding industry etc were notified to the Chief
Inspector of factories.
Due to the untiring efforts of
NIOH scientists, a large number of cotton textile mill workers
suffering from byssinosis could successfully get their
compensation claims.
